Terms of Service

1. What this service is

Palo Duro Air Repair connects Amarillo-area homeowners with independent, third-party HVAC contractors for AC repair and replacement work. We don't perform HVAC repairs ourselves — we help you find a provider who does.

When you submit a request or call, we match it with an independent contractor who reports holding an active Texas Air Conditioning and Refrigeration Contractor license and serving your area, and we pass your request to them. The contractor — not Palo Duro Air Repair — contacts you, diagnoses your system, quotes the work, and, if you hire them, performs it. Any agreement for HVAC services is between you and that contractor. We are not a party to it, we don't set or guarantee their prices, and we don't supervise their work.

2. Eligibility

You must be at least 18 years old to use this service, submit a request, or opt in to text messages. By using the service you represent that you are 18 or older and that the phone number you provide is yours or one you are authorized to use.

3. Independent providers; no endorsement or guarantee

• Contractors we match you with are independent businesses. They are not our employees, agents, partners, or joint venturers.
• We work with providers who report holding an active Texas Air Conditioning and Refrigeration (ACR) Contractor license issued by the Texas Department of Licensing and Regulation (TDLR). Verify any contractor yourself at the TDLR license lookup (tdlr.texas.gov/LicenseSearch/) before hiring.
• We do not verify any contractor's insurance, bonding, workmanship, or pricing on your behalf, and inclusion of a company on any page of this site — including the companies page — is not an endorsement, rating, or guarantee.
• You are responsible for evaluating any contractor before hiring them, including obtaining written quotes, checking licenses at the Texas Department of Licensing and Regulation, and confirming permits and warranties.

4. Cost figures and informational content

The cost ranges, regulatory summaries, and guides on this site are provided for general information. They reflect sources and dates stated on each page, are reviewed on the schedule stated there, and can go out of date. They are not a quote, an estimate for your specific job, or legal, tax, or insurance advice. Actual prices are set by the contractor who quotes your work. Always confirm regulatory, tax, and insurance matters with the appropriate professional.

5. Consent to be contacted

By submitting a request or calling us, you ask us to contact you about that request and to share it with a matched contractor who may contact you. If you check the consent box on the quote form, you additionally agree that Palo Duro Air Repair and the independent HVAC provider(s) matched to your request may contact you by telephone call or text message at the number you provided, including using automated dialing technology and prerecorded or artificial voice messages, about your request. Checking the box is not a condition of receiving a quote or of any purchase; you may leave it unchecked and we will reach you by a manually dialed call. We record the consent text shown to you and the time you agreed. If you are later matched with a provider not named to you at the time of consent, that provider must obtain its own consent before sending you automated marketing.

6. Text messaging (SMS) program terms

• Program description: Palo Duro Air Repair sends customer-care text messages related to a service request you initiated — confirming details, letting you know a provider is following up, or answering your questions. This is not a recurring marketing program.
• Frequency: message frequency varies based on your request; typically a small number of messages per request.
• Cost: message and data rates may apply according to your mobile carrier's plan. Palo Duro Air Repair does not charge for messages.
• Opt out: reply STOP to any message at any time. You'll receive a single confirmation message and no further texts from that number. You may also opt out through the contact page.
• Help: reply HELP to any message, or use the contact page.
• Carrier disclaimer: mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier network availability.
• Age: you must be 18 or older to participate.
• Privacy: how we handle your opt-in data — including that it is never sold or shared for third-party marketing — is described in our Privacy Policy.

7. Acceptable use

You agree not to:

• submit false, misleading, or someone else's information, or requests you don't intend to pursue;
• use the site to harvest contractor or user information, send spam, or scrape content for republication;
• interfere with the site's operation, attempt to bypass security or the form's anti-abuse measures, or introduce malicious code;
• use the service for any unlawful purpose.

We may decline, delay, or stop routing any request at our discretion, including if we believe it violates these terms.

8. Intellectual property

The text, graphics, layout, and original images on this site are owned by or licensed to Palo Duro Air Repair and protected by copyright. You may view, print, and share individual pages for personal, non-commercial use with attribution and a link. You may not republish site content in bulk or present it as your own. Third-party names and trademarks (contractor names, manufacturer names, agency names) belong to their owners and are used only to identify them.

9. Disclaimers

THE SITE AND THE REFERRAL SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, PALO DURO AIR REPAIR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY CONTRACTOR WILL CONTACT YOU, BE AVAILABLE, QUOTE ANY PARTICULAR PRICE, OR PERFORM ANY WORK TO ANY STANDARD, AND WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY COST FIGURE OR INFORMATIONAL CONTENT.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PALO DURO AIR REPAIR AND ITS OPERATOR, OWNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM THE ACTS OR OMISSIONS OF ANY INDEPENDENT CONTRACTOR YOU ARE MATCHED WITH, INCLUDING DEFECTIVE WORK, PROPERTY DAMAGE, PERSONAL INJURY, DELAY, OR OVERCHARGE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Palo Duro Air Repair and its operator from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these terms, your misuse of the service, or your dealings with any contractor.

12. Disputes and governing law

These terms are governed by the laws of the State of Texas without regard to conflict-of-law rules. Any dispute relating to the site or the service that cannot be resolved informally will be brought in the state or federal courts located in Potter County, Texas, and you consent to their jurisdiction. Nothing here limits any non-waivable consumer rights you have under applicable law.

13. Changes to these terms

We may update these terms; the effective date at the top will change when we do. Continued use of the site after a change means you accept the updated terms. Material changes to the SMS program will be communicated as required by carrier rules and applicable law.

14. General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. These terms, together with the Privacy Policy, are the entire agreement between you and Palo Duro Air Repair regarding the site.
